This course will examine estate planning and issues arising out of the transmission of property upon death. Topics will include testate and intestate succession, limitations on testamentary freedom, formalities of execution and revocation of Wills, testamentary capacity (including the role of the lawyer in assessing capacity), testamentary trusts, Powers of Attorney and guardianship, Will interpretation, the role of the executor, tax planning on death and common drafting issues.

Evaluation
One written assignment (20%), class participation (10%) and a final 3-hour open book examination (70%). The assignment will be a Will-drafting exercise which includes drafting a portion of a Will based on a fact pattern and a model Will (750 to 1500 words) which will be provided.
