Privacy and the AHRA: Assisting in the Collection of Information for the Assisted Human Reproduction Agency of Canada

Privacy is of paramount importance in the use of assisted human reproductive technologies. Individuals disclose significant personal and health information when donating reproductive material and when undergoing assisted human reproduction procedures. The Assisted Human Reproduction Act has created a specific statutory framework governing the collection, use and disclosure of this information. The AHRA also creates an agency, the Assisted Human Reproduction Agency of Canada, which has a broad mandate to create and maintain a registry of identifying and non-identifying health information about Canadians who use these technologies. This presentation will explore whether these provisions are consistent with fair information practices and whether they threaten the privacy of those participating in these technologies.

 

 

Vanessa Gruben -B.Sc.H. (Life Sciences, Queen’s University), LL.B. (University of Ottawa), LL.M. (Columbia University), of the Bar of Ontario -) graduated from the University of Ottawa’s English common law program. Following her graduation she clerked for Chief Justice Richard of the Federal Court of Appeal and Justice Bastarache of the Supreme Court of Canada. She was called to the bar in Ontario in 2003. She joined the faculty after graduating as a James Kent Scholar from Columbia University. Before returning to graduate school, Vanessa was an associate in the litigation group of a national law firm. Her research interests include assisted human reproduction, access to health care and health and human rights.
