This course addresses themes which arise in constitutional democracies around the world to examine the relationship between the judiciary and the legislature, the state and civil society, institutions and people. We will also look at populist authoritarian threats to constitutionalism and seek to understand the factors that may weaken or strengthen courts in varying contexts. The course will offer unique insights into the realities of deciding crucial issues based on constitutional law, based on actual experience in the Canadian Supreme Court and the German Federal Constitutional Court.

Evaluation
Students will be evaluated based on a final paper of 2500 to 3000 words (90%) and class participation (10%). Papers must be delivered to the Records Office by 4:00 p.m. on February 5, 2024.
