The trust is a way of holding property for the benefit of someone else. This simple and ancient device has applications across a range of modern personal and commercial contexts. Indeed, the trustremains some have argued the greatest achievement of our system of law and one of its distinguishing features. This course will examine the nature and structure of the trust, its essential components, selected problems in its administration and finally remedies.

The trust is a creation of the branch of jurisprudence known as Equity. The course offers an opportunity to increase understanding of the nature of Equity, operating as a supplement to the basic common law. The trust also bears a very close relationship to other private law relationships. In this course, we will also consider ways in which the trust is similar but distinct from these other private law relations, including agency, bailment, contract, debt and powers of appointment.
