This course will examine issues arising out of the transmission of property upon death. Topics will include testate and intestate succession, limitations on testamentary freedom, formalities of execution and revocation of wills, testamentary capacity, testamentary trusts, Powers of Attorney and guardianship, tax planning on death and common drafting issues.

Evaluation
Two written assignments. The first assignment will be a will drafting exercise in two parts, one of which will be due during the last week of January and the second part due the first week of March, for a total of 2,000 to 2,500 words - excluding the Will precedent which will be provided -(35% for both parts) and the second assignment will be 4,000 to 4,500 words (55%). Class participation (10%).
