This seminar is designed to enable students to explore in depth some of the evidentiary issues that arise in criminal litigation. The focus will be on difficult areas of the laws of evidence or areas that are in the process of change and development.
Topics may include competence ("married" persons and children), opinion evidence, privilege, testimonial aids, prior statements, character evidence, similar fact evidence, hearsay, evidence of the complainant’s sexual history, self-incrimination, and section 24(2) of the Charter.

Evaluation
6000-7500 word paper (75%), class participation including attendance and input into discussion (10%) and 5 short memos, each about 1-2 pages in length, on the readings in advance of 5 classes (15%).
